Alec Baldwin Vehemently Proclaims Innocence in The Fatal ‘Rust’ Incident

Alec Baldwin disclaimed any guilt in regards to the fatality of cinematographer Halyna Hutchins and pleaded not guilty to a charge of involuntary manslaughter.

On Thursday, Alec Baldwin forwent his first hearing before a judge and instead decided to enter his plea via documents acquired by Fox News Digital.

On Friday at noon Eastern Time, the ex-cast member of “30 Rock” was set to make a virtual court appearance.

He is barred from owning firearms or any other weapon and must abstain from consuming alcohol while on release, an obligation that should not be difficult for Baldwin, who has been sober since 1985.

Baldwin’s contact to potential witnesses in the “Rust” case is strictly limited, and he can only converse with them regarding completing filming of the movie. Any discussion of the incident itself is forbidden according to documents.

“Related business matters” refers to finishing the film, promoting the film and other activities, while “unrelated business matters” refers to other business-type relationships Baldwin may have with witnesses.

After a triumphant legal dispute, Baldwin has chosen to forgo his initial appearance. On Friday morning, the public prosecutors elected to remove the firearm enhancement that had been tacked onto one of his involuntary manslaughter charges.

His attorneys contended that the prosecution had committed a “fundamental legal mistake” as the law did not exist when he fired his gun.

The prosecution argued that the enhancement had been removed to “prevent potential legal distractions” during the trial.

“In order to avoid further litigious distractions by Mr. Baldwin and his attorneys, the District Attorney and the special prosecutor have removed the firearm enhancement to the involuntary manslaughter charges in the death of Halyna Hutchins on the ‘Rust’ film set,” Heather Brewer, spokesperson for the district attorney, told Fox News Digital. “The prosecution’s priority is securing justice, not securing billable hours for big-city attorneys.”

On behalf of Baldwin, his attorneys have petitioned for the special prosecutor to be dismissed from this case. They argued that Andrea Reeb couldn’t possibly maintain her role as a special prosecutor and simultaneously act as an assembly member in the New Mexico House of Representatives.

“Doing so vests two core powers of different branches — legislating and prosecuting — in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution,” the legal documents read.

On Friday, Judge Mary Marlowe Sommer granted the prosecution more time to respond to the motion that requested a special prosecutor.

On the set of “Rust” in New Mexico, a gun owned by Baldwin discharged and fatally wounded Hutchins on October 21st, 2021. Additionally, it injured Joel Souza who was directing at the time.

The prosecutors presented an extensive and specific case against Baldwin in the probable cause statement released on January 31, which was obtained by Fox News Digital.

“Baldwin’s deviation from known standards, practice and protocol directly caused the fatal death of Hutchins,” the documents state.

“By not receiving the required training on firearms, not checking the firearm with the armorer, letting the armorer leave the firearms in the church without being present, deviating from the practice of only accepting the firearm from the armorer, not dealing with the safety complaints on set and/or making sure safety meetings were held, putting his finger on the trigger of a real firearm when a replica or rubber gun should have been used, pointing the firearms at Hutchins and Souza, and the overall handling of the firearms in a negligent manner, Baldwin acted with willful disregard for the safety of others and in a manner which endangered other people, specifically Hutchins and Souza.”
