Could you go to Jail for Sharing your Netflix Password?

No. No you won’t.

A recent ruling made by the the United States 9th Circuit Court of Appeals issued a ruling this week that caused some panic. But this had nothing to do with consensual password sharing. It involves hacking.

“I would hold that consensual password sharing is not the kind of ‘hacking’ covered by the CFAA.” – Judge Stephen Reinhardt.

Both the HBO Chairman and Chief Executive and the Netflix CEO have both said that while password sharing isn’t encouraged, it hasn’t become a big enough problem to call network attention.

HBO Go’s Terms of Service currently state that you must be a subscriber with an account in good standing with an authorized distributor of HBO to use the app while Netflix’s current Terms of Service says that a household can share an account and that its users can watch Netflix on six different devices, and stream shows on up to two of those devices at the same time.

Now this doesn’t mean that the ruling won’t lead to stricter password laws in the future.

So #NetflixandChill and if you’re still a little worried, you can always keep an eye out for any policy changes or even just change your password.
